Removal of Maximum Allowable Consideration

There have been recent changes made to the Independent Health Facilities Act, the legislation which governs operation, quality assurance and licensing provisions for independent health facilities in the province. The changes were enacted through the introduction and passing of the Government Efficiency Bill in November of 2002.

The Independent Health Facilities Act allows the minister to control the maximum allowable consideration for the goodwill value of the licence of the independent health facility in the sale or transfer of the facility. The amendments will remove from the Act all controls over the maximum allowable consideration.

The amendments will make it a provincial offence not to disclose information as required.

The amendments also correct an editorial error.

A revised application for transfer of an independent health facility has been prepared and is available through the Independent Health Facilities Program. Please note also that due to internal policy requirements any consent to transfer a licence issued by the Director is time limited to 90 days from the date of issue.
